  • 2018 LAWPRO Report to Convocation

  • Pay your 2017 premiums on or before February 7, 2017 and save $50 per lawyer (some conditions apply) (Jan. 4, 2017)

    You can choose to pay your 2017 premium for your professional liability insurance in a lump sum, or by quarterly or monthly instalments. But only lump sum payments, made by cheque or pre-authorized bank account withdrawal, qualify you for the $50 per lawyer early payment discount.

    To benefit from the early payment discount ($54 per insured lawyer from the invoiced amount – $50 for the discount and $4 for PST), you must pay the premium indicated on your invoice in full by cheque, dated and received by LAWPRO on or before February 7, 2017. Please note that paying in a lump sum by credit card does NOT qualify for the early payment discount.

    Please ensure that you remit the total premium amount as indicated on the premium Invoice, and not the amount indicated on the Declarations page, as that amount does not include the claims history levy surcharge (if applicable) or the PST. Your cheque should be made payable to The Law Society of Upper Canada and mailed to LAWPRO at 250 Yonge Street, Suite 3101, P.O. Box 3, Toronto, Ontario M5B 2L7. Please DO NOT include payments for Law Society membership fees in your mail to LAWPRO.

  • Improved credit card security (Dec. 12, 2016)

    We are happy to announce that beginning on January 3, 2017, all credit card information that you provide to LAWPRO will be stored on the secure site of Moneris, a third party secure payment service company, for payment processing.

    There is no added work on your part, just added security that your credit card information is being processed and stored by Moneris, a nationally recognized expert in online transactions.

    Using a third party expert to store your credit card information ensures the privacy of your credit card information and meets the Payment Card Industry Data Security Standard.

    During the changeover process from 5:00 pm December 21 to 8:30 am January 3, credit card processing will be unavailable. During this time, other payment methods will continue to be available.   • 2017 renewal insurance application filing deadline has now passed! (Nov. 18, 2016)

    The deadline to file your renewal insurance application was November 10, 2016. Applications filed after November 10, 2016, are subject to a surcharge equal to 30% of the base premium. Please note that the November 3 e-file discount to save $25 per lawyer has also passed.

    2017 Renewal applications are no longer being accepted on-line. If you have not yet filed your renewal application form, you must complete a paper renewal application and submit it by fax to LAWPRO Customer Service at 416-599-8341 or 1-800-286-7639. You can download and print a copy of your 2017 pre-populated renewal application from the "PRIMARY POLICY DOCUMENTS" tab in MY LAWPRO.

    Furthermore, as paper renewal applications are no longer automatically sent by regular mail, please note in your calendar that you can either download your printable application from MY LAWPRO or file your renewal application online on or about October 1st each year. Email reminders will be sent in early October if we have an email address on file. Real Estate Transaction Levy Surcharge waived in respect of TitlePLUS insured transactions

A Release and Indemnity Agreement in favour of Law Society members, has been provided in agreed upon form to the Law Society of Upper Canada, by the Lawyers' Professional Indemnity Company ("LAWPRO") in respect of its TitlePLUS business.

Effective April 1, 2005, the release and indemnity protection provided by title insurers to Law Society members in accordance with the Real Estate Transaction Levy Surcharge provisions of the Law Society's professional liability insurance program, must be in a form satisfactory to the Law Society.

This change minimizes the administration required of lawyers and law firms in respect of individual transactions, by allowing them to readily ensure that the required release and indemnity protection is in place in a consistent form on a consistent basis with a specific title insurer.

Consequently, the $50 real estate transaction levy surcharge will continue NOT to apply, in respect of real estate transactions closing on or after April 1, 2005, where LAWPRO has issued a TitlePLUS policy in favour of all of the transferees and chargees obtaining an interest in or charge against the land which is the subject of the transaction, and where the lawyers is not also acting for the transferor in respect of the transaction.1

The Release and Indemnity Agreement provided in favour of Law Society members by LAWPRO in respect of its TitlePLUS business follows:

To the Members of the Law Society of Upper Canada

Pursuant to the requirement of the Endorsement(s) to the Law Society Professional Liability Insurance Policy (herein "Policy") that deal with the Real Estate Transaction Levy Surcharge, please accept this letter as evidence of our agreement with you, the members of the Law Society of Upper Canada, that where a title insurance policy(ies) is (are) issued in favour of all of the transferees and chargees obtaining an interest in or a charge against the land which is the subject of a real estate transaction, we agree to:

(i) indemnify and save harmless the member of the Law Society of Upper Canada and the member's law firm ("the member") acting as solicitor(s) for the transferee(s), chargee(s) and /or the title insurer(s) from and against any claims arising under the title insurance policy(ies), except for the member's gross negligence or wilful misconduct; and

(ii) release our right to maintain a negligence claim against the member(s) acting as solicitor(s) for the transferee(s), chargee(s) and/or the title insurer(s), except for the member's gross negligence or wilful misconduct.

This agreement shall irrevocably apply to all transactions completed on or after January 1, 1998 to November 18, 2004 except where it is shown that a Real Estate Transaction Levy Surcharge was paid, and to all transactions closed between November 18, 2004 and December 31, 2005 where the title insurance policy has been ordered on or before December 31, 2005. We reserve the right to terminate the remainder of the term of this Agreement if required by the Office of the Superintendent of Financial Institutions, or any other regulatory body having jurisdiction over our company, not to provide this indemnity and release, or within forty-five (45) days of being notified of any mid-term change to the Policy that affects the Real Estate Transaction Levy Surcharge. In the event of termination of the remainder of the term of this Agreement, any such termination would be effective thirty (30) days from the receipt of notification of termination by the Chief Executive Officer of the Law Society, so as to allow for communication by the Law Society of the termination of this Agreement.

This agreement shall automatically renew for a further one-year irrevocable term on January 1, 2006 and for each subsequent year on January 1 of that year, unless we provide notice in writing to the Chief Executive Officer of the Law Society of Upper Canada, by the later of November 1st of the current year of this Agreement or within forty-five (45) days of receipt of a copy of any Lawyers' Professional Indemnity Company (herein "LawPRO") Report to Convocation affecting the Real Estate Transaction Levy Surcharge, that this agreement shall terminate effective January 1 of the following year.

Lump sum payment of 2018 premium by cheque or pre-authorized bank account withdrawal received on or before this date are eligible for a $50 (per lawyer) early payment discount on the 2018 policy premium (see the 2018 Program Guide for details).
