  • 2018 LAWPRO Report to Convocation

  • Pay your 2017 premiums on or before February 7, 2017 and save $50 per lawyer (some conditions apply) (Jan. 4, 2017)

    You can choose to pay your 2017 premium for your professional liability insurance in a lump sum, or by quarterly or monthly instalments. But only lump sum payments, made by cheque or pre-authorized bank account withdrawal, qualify you for the $50 per lawyer early payment discount.

    To benefit from the early payment discount ($54 per insured lawyer from the invoiced amount – $50 for the discount and $4 for PST), you must pay the premium indicated on your invoice in full by cheque, dated and received by LAWPRO on or before February 7, 2017. Please note that paying in a lump sum by credit card does NOT qualify for the early payment discount.

    Please ensure that you remit the total premium amount as indicated on the premium Invoice, and not the amount indicated on the Declarations page, as that amount does not include the claims history levy surcharge (if applicable) or the PST. Your cheque should be made payable to The Law Society of Upper Canada and mailed to LAWPRO at 250 Yonge Street, Suite 3101, P.O. Box 3, Toronto, Ontario M5B 2L7. Please DO NOT include payments for Law Society membership fees in your mail to LAWPRO.

  • Improved credit card security (Dec. 12, 2016)

    We are happy to announce that beginning on January 3, 2017, all credit card information that you provide to LAWPRO will be stored on the secure site of Moneris, a third party secure payment service company, for payment processing.

    There is no added work on your part, just added security that your credit card information is being processed and stored by Moneris, a nationally recognized expert in online transactions.

    Using a third party expert to store your credit card information ensures the privacy of your credit card information and meets the Payment Card Industry Data Security Standard.

    During the changeover process from 5:00 pm December 21 to 8:30 am January 3, credit card processing will be unavailable. During this time, other payment methods will continue to be available.   • 2017 renewal insurance application filing deadline has now passed! (Nov. 18, 2016)

    The deadline to file your renewal insurance application was November 10, 2016. Applications filed after November 10, 2016, are subject to a surcharge equal to 30% of the base premium. Please note that the November 3 e-file discount to save $25 per lawyer has also passed.

    2017 Renewal applications are no longer being accepted on-line. If you have not yet filed your renewal application form, you must complete a paper renewal application and submit it by fax to LAWPRO Customer Service at 416-599-8341 or 1-800-286-7639. You can download and print a copy of your 2017 pre-populated renewal application from the "PRIMARY POLICY DOCUMENTS" tab in MY LAWPRO.

    Furthermore, as paper renewal applications are no longer automatically sent by regular mail, please note in your calendar that you can either download your printable application from MY LAWPRO or file your renewal application online on or about October 1st each year. Email reminders will be sent in early October if we have an email address on file. If you require assistance or have any questions, please contact our Customer Service Department at 416-598-5899 or 1-800-410-1013.

(If you cannot remember that password or need to set up a new one, follow the online instructions or contact LAWPRO Customer Service at 416-598-5899 or 1-800-410-1013).

    Select Renew Professional Liability Insurance for 2017 and complete the filing using the online instructions. If filing your renewal application online, please note that you will have successfully e-filed when you receive a confirmation number that begins with the letter "P".

Information on reduction in Goods and Services Tax (GST)
Date: June 13, 2006

Lawyers should be aware that the 2006 federal budget contains proposals for the reduction of the GST rate to six per cent from seven per cent effective July 1, 2006. Lawyers should consider reviewing their billing and accounting practices in light of the proposed amendments.

Transaction Levy Surcharges
For your information we have summarized the implications of these GST proposals on the Real Estate and Civil Litigation Transaction Levy Surcharges for lawyers.

Remittance of the Transaction Levy Surcharges to LAWPRO
Transaction Levy Surcharges are considered insurance premiums and therefore, like the basic premiums for your professional liability insurance, are NOT subject to GST. The total amount that is to be remitted to LAWPRO therefore remains unchanged at $50 per transaction regardless of the proposed change in the GST rate.

Calculating the Transaction Levy Surcharge when it is disbursed to clients
As you are aware, you may disburse the full $50 Transaction Levy Surcharge on your invoices to clients. This disbursement is subject to GST. In most circumstances and as a general rule, lawyers issuing invoices to clients dated on or after July 1, 2006, would apply GST at the new rate of six per cent, being $3.00 on each $50 Transaction Levy Surcharge disbursed to clients.

New transitional rules for sales of real property
The budget also contains specific transitional rules for the GST rate reduction with respect to sales of real property. The transitional rules set out the circumstances in which the reduced percentage rate will apply and the circumstances in which a purchaser may claim a rebate from the Canada Revenue Agency. Factors such as the date of the agreement of purchase and sale and the date of closing (i.e., where ownership and possession of the property is transferred) may affect the amount payable and the entitlement to a rebate.
