Hotsheet: Gap Coverage during an OPSEU Strike

Land Registration Services schedule during OPSEU Strike, beginning March 13, 2002:

We are advised that Land Registry Offices will be open from 1:00 p.m. to 4:00 p.m. Monday to Friday. This may be subject to change. Land registration hours for remote users of the e-reg system will be 8:30 a.m. to 4:00 p.m. In addition, the hours for Writ Search, TitlePLUS and POLARIS searching via Teraview will be as usual: 8:00 a.m. to 8:00 p.m. Monday to Thursday, and 8:00 am to 6:00 pm Friday.

When You Cannot Search Title or Executions
If a closing date is approaching, and, due to a strike situation, you:

  1. have not been able to conduct a full search on a Registry property; or
  2. have not been able to obtain a copy of the Land Titles Register for a property; or
  3. have not been able to obtain execution certificates on the vendor or, where there is a mortgage, the purchaser;
call TitlePLUS for assistance.

Protection When You Cannot Register Your Documents on the Closing Date
TitlePLUS will provide coverage where both parties to a transaction are ready to close, but the purchaser's solicitor is unable to register the Transfer and other closing documents on the closing date because of a strike situation.

TitlePLUS will protect the insured purchaser and lender clients in this situation, at no additional premium, in accordance with the following requirements:

  1. The purchaser's solicitor must conduct a subsearch of title, and obtain the normal executions certificates, and these searches must be clear. If, as a result of a strike situation, it is not possible to do this on the scheduled closing date, these searches should be conducted either on the business day before the scheduled closing date, or at any time prior to registration of the closing documents, in accordance with no. 5 below. If a subsearch or executions certificate discloses a new registration or execution, contact TitlePLUS for instructions.
  2. The purchaser's solicitor and the vendor's solicitor must have reviewed and exchanged on-title and off-title documents, including registrable documents, and each must be satisfied with the documents he or she has received.
  3. As soon as the purchaser's solicitor becomes aware that he or she will not, or may not, be able to register on the closing date, he or she should call TitlePLUS Customer Service at (416) 598-5899 or 1-800-410-1013. The TitlePLUS representative will ask the solicitor to confirm that the above requirements have been, or will be, completed in accordance with nos. 1 and 2 above, and will then verbally advise the solicitor that he or she can proceed to release the closing funds.
  4. The TitlePLUS representative will fax confirmation of the above to the purchaser's solicitor. However, the purchaser's solicitor does not need to wait to receive this fax before releasing the closing funds.
  5. The purchaser's solicitor must register the closing documents as early as possible on the next business day. If this is not possible due to a strike situation, then the documents must be registered at the earliest possible time. No further subsearch or execution certificates are required, except as set out in no. 1 above, and except as necessary to register a Transfer in Land Titles.
  6. The purchaser's solicitor is not required to notify TitlePLUS that registration has been completed.

A TitlePLUS policy for which this coverage is granted will protect the insured purchaser and lender regarding any intervening registrations or writs of execution, from the time of releasing funds to the time of registration of the closing documents.

Hotsheet: TitlePLUS Program Codes and Premiums
Effective Monday, April 3, 2000, all TitlePLUS Program Codes will automatically calculate the custom premiums. You will no longer need to await a manual review in order to have the premiums adjusted.

In order to obtain premium reductions under our special programs (GoodStart, Certified TitlePLUS Specialist, MortgageOnly, etc.) you must input the appropriate TitlePLUS Program Code into the Program Code field in the Basic Data section of the TitlePLUS application. You must be using the most current version of Teraview and TitlePLUS (4.1/2.1a).

HOW IT WORKS

Preliminary Submission: If a program Code is added, removed, or changed prior to a preliminary submission being made, the premium will be calculated upon submission in accordance with the specific code entered.

No manual review will be triggered by the entry of the code and no manual approval will be required (although a manual review may still be triggered by something else in the application).

Full Application Submission: If a program Code is added, removed, or changed prior to a full application submission being made, no manual review will be triggered by the entry of the code and no manual approval will be required (again, a manual review may still be triggered by something else in the application).

Upon submission, the system will check to see if a manual adjustment of the premium has been made by TitlePLUS and if not, the premium will be calculated or recalculated in accordance with the specific code entered.

If a manual adjustment has been made by TitlePLUS, the program code entry will not overwrite the manually set premium. The manually set premium will be the premium for the deal.

Whenever the premium recalculates, the user will get a message advising of the new premium amount. The user can accept the premium amount set out in the message or can refuse it by clicking the appropriate "Yes" or "No" button.

If the premium is accepted, the submission will go through to completion, the information will go to the server and the new premium will appear on your local desktop.

If the premium is rejected, the submission will not go through to completion, as no information will be sent through to the server. However, the new premium will still show on your local desktop until your next submission is completed at which time the premium will recalculate to match the premium amount on the server.

Reset to Full: If you "Reset to Full" and resubmit your full application, the same procedure as for the full application submission is followed.

Issuance Submission: The same procedure as for the full application submission is followed.

Please note that you will have to "Accept" the system's premium at some point for submissions to be complete, otherwise a policy cannot be issued.

New land registration fees in effect December 5, 2000
Effective December 5, 2000, there will be new statutory land registration fees. In addition, Teranet announced that effective December 5, 2000 remote electronic document registration will be subject to a remote service charge per document of $10 plus GST. The fees that will apply on December 5, 2000 are set out as follows:
